Note on Scripts & Regional Access: Some parts of this site use scripts to enforce regional access restrictions in compliance with international laws such as the Kids Online Safety Act (USA) and Online Safety Act 2023 (UK). These scripts do not collect personal information beyond minimal IP data for access determination. The Privacy Policy and Terms of Service themselves are fully accessible to all users.

By accessing or using Jessica’s Unified Switchboard (“the Site”), you agree to these Terms of Service (“TOS”), which include the Acceptable Use Policy (“AUP”) and Privacy Policy. If you do not agree, do not use the Site.

1. Acceptable Use Policy (AUP)

Users are strictly prohibited from engaging in the following activities:

• Illegal Content: Child sexual abuse material, non-consensual intimate images, terrorism or violent extremism content, hate crimes.
• Harassment and Abuse: Cyberbullying, stalking, intimidation, or harassment.
• Discrimination: Content discriminating based on race, gender, sexual orientation, religion, nationality, disability, or age.
• Violent or Self-Harm Content: Promoting violence, suicide, or self-harm.
• Impersonation: Misrepresenting identity or affiliation.
• Malicious Activity: Disrupting, damaging, or interfering with the Site.

Enforcement:

• Reporting: Violations can be reported to [email protected].
• Action: Content removal, account suspension, or termination may occur after investigation.
• Appeals: Users may submit appeals; responses usually within 48 hours, up to 7 days in exceptional cases.

Social Platform (Future Use Only): Default safety settings will be highest protection and safe for users 16+.

Note: Future social platform features may include optional scripts for age verification and identity validation. These scripts will be used solely for safety and compliance, and no personal data will be exposed publicly.

2. Age Verification (Future Social Platform Features)

• Required Materials: Government-issued ID with number obscured; showing date of birth, full name, and facial image.
• Self-photo (selfie) for verification.

Transgender Users: Inform the Site if legal ID does not reflect your current gender. Verification ensures safety, accuracy, and respect. The process may take additional time.

Access and Credentials: Validated users receive a username and temporary password, which must be updated on first login.

Privacy & Retention: Verification data is encrypted and stored securely (VeraCrypt). Compliant users’ verification data is deleted within 90 days. Data related to violations may be retained for law enforcement reporting.

Minimum Age: Users must be 16 years or older for social features.

3. Site Administration & Identity Respect

Operated solely by Jessica Shinsky (legal name: John Shinsky).

Users must not use or refer to the legal name, except for:

• Licensed attorneys
• Law enforcement agencies
• Child protection organisations (e.g., CMEOC or equivalent)

4. Privacy Policy

Jessica’s Unified Switchboard complies with all relevant privacy laws:

• United States: Federal and state laws (California, Oregon, COPPA, HIPAA, GLBA, CCPA/CPRA)
• European Union: GDPR (server located in Germany)
• Australia: Privacy Act 1988 and Australian Privacy Principles (APPs)
• Canada: PIPEDA
• New Zealand: Privacy Act 2020

Information We Collect:

• IP Address: Via Cloudflare for security.
• Email Address: Only if you contact us or access services manually.
• Other Usage Info: Minimal technical data for site security and functionality.

Usage: Operate and improve the Site and services, respond to inquiries, ensure site security, and comply with legal obligations.

Disclosure: Service providers assisting with operations or security, legal authorities as required by law, affiliates or partners only as legally permitted. No PHI or PCI DSS-regulated data collected or shared.

Data Security: Technical and organizational safeguards are in place. Absolute protection cannot be guaranteed.

International Transfers: Data transferred internationally (e.g., Germany) complies with GDPR and other applicable laws.

Payments: Processed via Square; Square’s Terms and Privacy Policy apply. No direct storage of payment card information.

Compliance Notes: HIPAA: Do not store PHI. PCI DSS: Payments handled by Square. GDPR/EU: Rights to access, correct, erase, and object guaranteed. US State Laws: Rights to access, deletion, and opt-out available. Canada (PIPEDA): Consent required; access and correction rights available. Australia: Access and correction rights under APPs. New Zealand: Access and correction rights under Privacy Act 2020.

5. Governing Law

• United States: Primary governing law is U.S. federal and state law.
• Australia: Governed by APPs; illegal content reported as required.
• European Union: GDPR compliance, Germany-based servers.
• Canada: PIPEDA compliance.
• New Zealand: Privacy Act 2020 compliance.

6. General Terms

Jessica’s Unified Switchboard may update TOS, AUP, or Privacy Policy at any time. Continued use constitutes acceptance of updates. Questions or appeals may be submitted to [email protected].
